Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Imbutae iOS application, the Imbutae website, and related services (together, the “Service”). The Service is operated by Errachdi Hafid, established in France (“Imbutae,” “we,” “us,” or “our”). You may contact us at contact@imbutae.fr. Please read these Terms and our Privacy Policy before using the Service.
1. Acceptance and Eligibility
By downloading, accessing, or using the Service, or by completing the onboarding acceptance control, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use the Service. If you have not reached the age of legal majority where you live, you may use the Service only with permission from a parent or legal guardian. The Service is not directed to children under 13. Where local law imposes a higher minimum age or requires parental authorization, that rule applies. Purchases by minors require the authorization of the Apple account holder and any consent required by law. If you use the Service on behalf of an organization, you confirm that you have authority to bind that organization to these Terms.
2. What Imbutae Provides
Imbutae is an editorial discovery and curation service designed to help users tune in to selected “voices,” discover short excerpts or “drops,” review contextual information, save content, organize a personal deck or Focus Stack, access source links, and participate in community prioritization features. Features may be available in guest mode, through an Imbutae account, through a paid purchase, or through an active subscription. Internet access, a compatible Apple device, and an Apple account may be required for certain features. Imbutae is an independent service. Unless expressly stated, Imbutae is not affiliated with, endorsed by, sponsored by, or officially connected to any person, organization, publisher, platform, or external service referenced in the Service.
3. Accounts and Sign in with Apple
Core features may be available without an account. Account-based features use Sign in with Apple and may include cloud synchronization, purchase verification, restoration, expanded limits, or other functionality described in the app. You are responsible for:
- maintaining control of your device and Apple account;
- providing accurate information where information is requested;
- taking reasonable steps to prevent unauthorized access; and
- notifying us promptly if you believe your Imbutae account has been compromised.
You may not create or use an account through automated means, impersonate another person, misrepresent your authority, or use another person’s account without permission. You may delete your Imbutae account through the app settings. Deleting an account is irreversible and may remove synchronized saved drops, voices you are tuned in to, deck data, Focus Stack settings, community activity, and other account data. Account deletion does not automatically cancel an App Store subscription or entitle you to a refund. See Section 8.
4. Limited License
Subject to these Terms and the applicable App Store rules, Imbutae grants you a personal, limited, revocable, non-exclusive, non-transferable, and non-sublicensable license to install and use the app on Apple-branded devices that you own or control, solely for lawful, personal, and non-commercial use. This license does not transfer ownership of the Service or any content. Any rights not expressly granted are reserved by Imbutae and the relevant rights holders.
5. Acceptable Use
You must not, and must not assist another person to:
- use the Service in violation of law or another person’s rights;
- access, copy, reproduce, redistribute, sell, license, publicly display, or commercially exploit the Service or its content except as expressly permitted;
- access, collect, copy, index, harvest, or extract content or data through bots, scripts, automated tools, or similar means without our written permission;
- reverse engineer, decompile, disassemble, attempt to derive source code, or circumvent technical restrictions, except to the limited extent such a restriction is prohibited by applicable law;
- interfere with, overload, disrupt, damage, or test the vulnerability of the Service or connected systems without authorization;
- bypass rate limits, purchase controls, community lift limits, access restrictions, or security measures;
- introduce malware, malicious code, deceptive links, spam, or fraudulent activity;
- submit unlawful, threatening, hateful, defamatory, harassing, sexually exploitative, privacy-invasive, or intellectual-property-infringing material;
- submit sensitive personal data, private contact information, or allegations about another person unless necessary for a legitimate report and permitted by law;
- manipulate community features through multiple accounts, automation, coordinated inauthentic activity, or other artificial means;
- impersonate a featured person or imply a false association with Imbutae; or
- remove or alter legal, copyright, trademark, attribution, or source notices. Restrictions on reverse engineering do not limit any non-waivable right available under applicable open-source, interoperability, or consumer law.
6. Editorial Content, Sources, and Third-Party Rights
6.1 Nature of the content
Imbutae presents selected excerpts, context, profile information, and links to original or third-party sources. Content may be shortened, categorized, translated, summarized, or placed alongside editorial context. Imbutae exercises editorial judgment when selecting, organizing, contextualizing, and presenting content. We aim to present content in a neutral, balanced, and useful way, but we do not guarantee that any topic, person, organization, source, or event will be covered exhaustively, completely, or without omission. We aim to preserve the meaning and source of featured material, but despite our editorial and technical processes, mistakes, omissions, outdated information, attribution errors, or inaccurate contextual information may occasionally occur. We do not guarantee that every excerpt, date, attribution, summary, translation, link, or contextual description is complete, current, or error-free. Some contextual descriptions, summaries, or classifications may be generated or assisted by automated systems, including AI tools, and may be incomplete or inaccurate. You should consult the linked original source before relying on a drop or sharing it as a complete statement. The availability of source materials may depend on third-party platforms, publishers, services, APIs, licensors, or other external actors. If any such material becomes unavailable, restricted, modified, or deleted, related content or features in Imbutae may also become unavailable without notice.
6.2 No endorsement or affiliation
The inclusion of a person, profile, statement, platform, trademark, or link does not mean that the person or rights holder endorses Imbutae, or that Imbutae endorses every opinion expressed in the source material. Views expressed in third-party material belong to their respective authors.
6.3 Ownership
Imbutae and its licensors own the app, software, interface, visual design, branding, original editorial material, databases, and other original elements of the Service. Third-party names, trademarks, public images, statements, articles, source materials, and linked materials remain the property of their respective owners. No provision of these Terms grants you a right to reuse third-party content beyond the rights provided by law or by the relevant rights holder.
6.4 Corrections and rights-holder requests
If you believe content is inaccurate, misleadingly presented, unlawfully used, or infringes your rights, contact contact@imbutae.fr with:
- the content or URL concerned;
- the nature of the requested correction or removal;
- the basis of your request; and
- information reasonably sufficient to verify your identity or authority where necessary. We may contextualize, correct, restrict, or remove content while reviewing a substantiated request. Nothing in this process limits rights or remedies available under applicable law.
7. Community Lifts, Voice Requests, Reports, and Feedback
Imbutae may let you support proposed voices through “lifts,” submit voice requests, report drops, or provide feedback. Lifts are participation signals only. They are not money, property, transferable assets, or a promise that a candidate will be selected. We may establish, correct, or change lift limits, eligibility rules, candidate lists, selection periods, and editorial criteria to protect fairness or improve the Service. We may disregard activity that appears automated, fraudulent, duplicative, abusive, or technically erroneous. Final editorial selection remains with Imbutae. Community rankings or totals are not binding and may be adjusted to correct fraud, abuse, refunds, system errors, or rule violations. You retain any rights you have in original feedback or text you submit. You grant Imbutae a worldwide, non-exclusive, royalty-free license to host, reproduce, review, and use that submission only as reasonably necessary to operate, secure, moderate, improve, or respond through the Service. For a feature idea or general feedback that does not contain confidential information, you also allow us to use the idea without restriction or compensation. Do not submit information you are not authorized to share. Support requests, reports, and voice requests are not public drops and are not designed as user-to-user communication.
8. Purchases, Imbutae+, Focus Stack, and Tips
All in-app purchases are offered and processed through Apple’s App Store. Prices, taxes, currency, payment authorization, billing, and refund processing are governed by Apple’s applicable terms in addition to these Terms. Imbutae does not receive your full payment-card details.
8.1 Imbutae+
Imbutae+ is an auto-renewable monthly subscription that provides the benefits displayed in the app at the time of purchase. Benefits may include expanded voice or lift limits, widgets, icons, or other supporting features. The exact price and subscription period shown in Apple’s purchase confirmation control over any illustrative text elsewhere. Where offered and where you are eligible, a one-week free trial converts automatically to a paid monthly subscription unless cancelled before the trial ends. Payment is charged to your Apple account at confirmation of purchase or at the end of the trial. The subscription renews automatically unless you cancel it through Apple at least 24 hours before the end of the current period. Apple may charge the renewal within 24 hours before the current period ends. You can manage or cancel Imbutae+ through the app’s “Manage subscription” control or your Apple account subscription settings. Cancellation prevents future renewal but generally does not retroactively refund the current period. Access continues for the remainder of the paid period unless Apple or applicable law provides otherwise. We may change future subscription pricing or benefits. Price changes and any required consent or notice are handled in accordance with Apple’s rules and applicable law. A material reduction affecting an already-paid period will not override your mandatory consumer rights.
8.2 Focus Stack purchase
The Focus Stack may be offered as a one-time, non-consumable in-app purchase. It unlocks the feature for the Apple account and/or Imbutae account associated with the verified purchase, subject to Apple’s restoration rules and technical compatibility. You must be signed in where the app requires an account to associate or synchronize the entitlement.
8.3 Optional tips
Optional tips are voluntary consumable purchases intended to support Imbutae. Unless the app expressly states otherwise before purchase, a tip does not purchase additional content, establish ownership, create an investment, or guarantee a feature or response. Tips are not charitable donations and we do not represent that they are tax-deductible.
8.4 Refunds and purchase restoration
Refund decisions and processing are handled by Apple, subject to applicable law. You can request a refund through Apple’s “Report a Problem” service. Imbutae cannot directly issue an App Store refund, but we will reasonably assist with entitlement issues. Where Apple permits, eligible non-consumable purchases and active subscriptions may be restored. Consumable tips are not restorable.
8.5 Account deletion and subscriptions
Deleting your Imbutae account or uninstalling the app does not cancel Imbutae+. You must cancel the subscription separately through Apple to prevent future renewal. Deleting the account may remove the cloud data needed for account-linked features even if a paid Apple entitlement remains active. If you later return, restoration is subject to Apple’s records and the then-current technical availability of the Service. Nothing in this Section limits refund, withdrawal, conformity, or other mandatory consumer rights that apply to you.
9. Third-Party Services and Links
The Service relies on or links to third-party services, including Apple, source services, Supabase, PostHog, and external websites. Third parties may impose their own terms and privacy policies. We do not control third-party content, availability, security, or conduct. You must comply with applicable third-party terms when using the Service. A link or integration does not imply endorsement. We are not responsible for a third-party service to the extent the issue is outside our reasonable control, but this does not exclude liability that cannot lawfully be excluded.
10. Service Changes and Availability
We may update, correct, improve, restrict, suspend, or discontinue all or part of the Service. This may be necessary for security, legal compliance, maintenance, platform changes, third-party availability, abuse prevention, or product development. We do not promise that every voice, drop, source, feature, entitlement, or platform integration will remain available indefinitely. We will use reasonable care and, where required, provide reasonable notice of a material adverse change. We will not use this Section to deprive consumers of paid rights contrary to mandatory law. The Service may be temporarily unavailable because of maintenance, network conditions, App Store services, third-party outages, emergencies, or events outside our reasonable control.
11. Suspension and Termination
You may stop using the Service at any time and may delete your account through the app. We may restrict or suspend access where reasonably necessary to:
- address a material or repeated violation of these Terms;
- protect users, featured people, Imbutae, Apple, or third parties;
- prevent fraud, manipulation, security incidents, or unlawful activity;
- comply with law, a court order, or a platform requirement; or
- manage a serious technical or operational risk. Where appropriate, we will provide notice and a reasonable opportunity to correct the issue. Immediate action may be taken for urgent security, fraud, legal, or safety reasons. We may terminate an account for a serious or repeated breach. Termination ends the license granted under these Terms. Provisions that by their nature should survive-such as ownership, payment obligations already incurred, disclaimers, liability limits, and dispute provisions-remain effective. Suspension or termination does not remove mandatory consumer rights.
12. Informational Service; No Professional Advice
The Service is for general discovery and informational purposes. It does not provide legal, medical, financial, investment, tax, safety, or other professional advice. A drop is an excerpt and may omit qualifications or surrounding discussion. Do not make important decisions solely on the basis of content displayed in Imbutae. Consult the original source and, where appropriate, a qualified professional.
13. Disclaimers
We provide the Service with reasonable care and skill. Except for warranties, guarantees, or remedies that cannot be excluded under applicable law, the Service is provided on an “as available” basis.
We do not guarantee that:
- the Service will always be uninterrupted, secure, or error-free;
- every source link or third-party service will remain available;
- editorial content will be complete, current, or suitable for a particular purpose; or
- the Service will meet every device, accessibility, or personal requirement. Nothing in these Terms excludes the legal guarantee of conformity or other mandatory rights available to consumers.
14. Limitation of Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, wilful misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence, or breach of mandatory consumer rights. Subject to the paragraph above, Imbutae is not liable for indirect or consequential loss that was not reasonably foreseeable when you accepted these Terms, or for loss caused solely by:
- your unlawful or unauthorized use of the Service;
- your failure to secure your device or Apple account;
- content, conduct, or availability of an independent third party; or
- an event outside our reasonable control that we could not reasonably prevent. Where you use the Service for business or commercial purposes contrary to the personal-use license, Imbutae is not liable for loss of profit, revenue, business opportunity, goodwill, or business data to the maximum extent permitted by law.
15. Apple-Specific Terms
These Terms are between you and Imbutae, not Apple. Imbutae, not Apple, is responsible for the Service and its content, maintenance, support, and any warranties that apply and are not lawfully disclaimed. Apple has no obligation to provide maintenance or support for the Service. To the extent permitted by law, if the app fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price paid for the app, if any; Apple has no other warranty obligation for the app. Imbutae, not Apple, is responsible for addressing claims relating to the app, including product-liability, legal or regulatory, consumer-protection, and intellectual-property claims, subject to these Terms and applicable law. You represent that you are not located in a country subject to a United States government embargo and are not listed on a United States government prohibited or restricted parties list, to the extent this representation is required by Apple’s minimum terms. You must comply with applicable third-party terms when using the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-specific provisions against you.
16. Governing Law and Disputes
These Terms are governed by French law. If you are a consumer living in the European Economic Area, the United Kingdom, Switzerland, or another jurisdiction with mandatory consumer protections, you also retain the protections of the mandatory laws of your country of residence. Nothing in these Terms requires you to bring a claim outside the courts available to you under mandatory consumer law.
Before filing a claim, you and Imbutae are encouraged to contact each other and attempt in good faith to resolve the dispute informally. Contact us at contact@imbutae.fr with a description of the issue and the resolution sought. Any consumer-mediation right that applies under French or European law remains available. Information about the competent consumer mediator, once applicable and appointed, will be stated in Imbutae’s Legal Notice or on the Service. This informal process does not suspend or remove any right to seek urgent relief or use a court where permitted.
17. Changes to These Terms
We may update these Terms to reflect changes to the Service, law, security needs, or business practices. We will post the revised Terms and update the date above. If a change materially affects your rights or an ongoing paid service, we will provide reasonable advance notice where required. Changes do not retroactively remove accrued rights. If you do not agree to a material change, you may stop using the Service and cancel any future subscription renewal. Continued use after the effective date of properly notified changes constitutes acceptance where permitted by law.
18. General Terms
If any provision is found unlawful or unenforceable, the remaining provisions remain effective, and the affected provision will apply to the maximum lawful extent. Our failure to enforce a provision is not a waiver. You may not transfer your rights or obligations under these Terms without our consent, except where mandatory law permits. We may transfer these Terms as part of a reorganization or transfer of the Service, provided your rights are not materially reduced. These Terms, the Privacy Policy, and any purchase information displayed and accepted at checkout form the agreement governing the Service. If purchase information conflicts with these Terms about price, duration, or trial eligibility, the information shown in Apple’s purchase confirmation controls for that transaction.
